IMPORTANT:
Your order will be accepted on the condition that you agree to be bound by the Terms and Conditions specified below. If you object to be bound by the Terms and Conditions you can not proceed with 49p Bizness order.

This agreement is between LuxmiNET, BGP Tecno Limited, and the authorised entity/person, who completes the on-line order form.

The Authorised Person will hereafter be referred to as 'User'. And the service provider is referred as either LuxmiNET or BGP or BGP Tecno Limited.

(1) Subject to the provisions hereof a service account will be opened upon reception of payment. The payment shall be repeated in each successive billable period thereafter at the applicable prevailing rates and charges, unless written or e-mail notice of cancellation is received from the User.

(2) The billing period starts on the day the Service become available to use by the User.

(3) LuxmiNET specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall LuxmiNET (BGP Tecno Limited) be liable for any loss, or loss of data, or any other damages.

(4) User agrees to protect and indemnify BGP Tecno Limited against any and all liability, loss, or expense arising from claims of libel, unfair competition, unfair trademarks, trade names or patents, violations of rights and privacy and infringement of copyrights and property resulting from User's use of LuxmiNET services.
User is solely responsible for usage of LuxmiNET services and any statement User makes on LuxmiNET's system.

(5) Inappropriate use of service
LuxmiNET reserves the right to cancel any account, at any time, without notice, if LuxmiNET considers inappropriate use by the User. The following are not allowed at LuxmiNET servers:

• sites containing adult material,
• sites with links to adult sites,
• sites encouraging or suggesting illegal activity
• sites that violate copyrights, trademarks or other intellectual property laws
• sites that use or suggest the use of unsolicited email ("spam")
• sites that publish content which is obscene, sexually explicit, abusive, or threatening

(6) User agrees not to use disk space provided by LuxmiNET for uploading files not directly related to his/her web site. At LuxmiNET's discretion, any such activities deemed inappropriate by LuxmiNET might result in termination of access to LuxmiNET's Internet Account. User also agrees not to use any server side program that requires unusual amount of server resources. If and when User's website server processing usage exceeds what is considered usual, LuxmiNET shall offer new pricing deemed appropriate for such usage.

(7) LuxmiNET shall be the sole arbiter of what constitutes unusual amount of server resources. User agrees not to store any archival files in the disk space on LuxmiNET servers. Violation of this rule may result in termination of access to LuxmiNET servers.

(8) Either party can cancel the service account by giving written or e-mail notification. If you cancel this very low cost hosting account LuxmiNET will not make any refunds on any unused portions of your account. Unused portion may range from 1 day to 30 days. When your account is closed all files you uploaded to LuxmiNET servers will be deleted.

(9) LuxmiNET reserves the right to amend and update these Terms and Conditions at any time. The User can view the latest copy of the Terms and Conditions at 49p Bizness site, http://www.49p.biz

(10) This agreement is only applicable to 49p Bizness package, and does not relate with BGP's or LuxmiNET's any other businesses or services.
